The deadline for the 2025 EB-5 Integrity Fund fee is October 1, 2024. This fee is mandatory for all designated regional centers participating in the EB-5 Immigrant Investor Program. Make sure to submit your payment on time to avoid late fees and compliance issues.
What Is a Designated Regional Center?
A designated regional center is an entity that has been approved by U.S. Citizenship and Immigration Services (USCIS) to participate in the EB-5 Immigrant Investor Program. These centers collect and manage investments from foreign nationals aiming to obtain U.S. green cards, channeling funds into American businesses. In return, these businesses are required to create jobs for U.S. workers, which can include both direct jobs and indirect jobs (those resulting from economic growth related to the investment).
Understanding the EB-5 Integrity Fund
Established in 2022, the EB-5 Integrity Fund is utilized by USCIS to oversee and ensure the integrity of the EB-5 program. The fund helps cover the costs of monitoring, auditing, and investigating regional centers to ensure they comply with program rules and regulations.
Who Is Required to Pay?
All regional centers must pay the annual Integrity Fund fee. The amount varies based on the number of investors tied to the regional center:
$20,000 for regional centers with more than 20 investors in their new commercial enterprises during the previous fiscal year.
$10,000 for regional centers with 20 or fewer investors.
Key Information for the 2025 Integrity Fund Payment
Due Date: The payment deadline is October 1, 2024.
Fee Amount: Most regional centers will owe $20,000, while smaller centers may pay the reduced fee of $10,000.
Payment Method: Payments must be submitted through the pay.gov website.
Late Payments: Regional centers that do not make the payment within 30 days of the due date will be subject to a late fee. Previously, failure to pay the fee would result in the center losing its designation. However, a recent court ruling protects centers from automatic termination for late or missed payments.
If you are responsible for managing a regional center, ensure that the payment is submitted on time to avoid additional fees.
