EB-2 NIW vs EB-1A: Which Green Card Path Is Right for You?

For Indian professionals seeking a U.S. green card, the employment-based preference categories can feel like a maze of acronyms, priority dates, and eligibility criteria. Two paths that frequently come up in conversation—particularly for those with advanced degrees or specialized achievements—are the EB-2 National Interest Waiver (NIW) and the EB-1A Extraordinary Ability category.

Both allow you to self-petition, meaning no employer sponsorship is required. But the standards are different, the timelines vary, and the right fit depends heavily on your individual background.

What Is the EB-2 NIW?

The EB-2 category covers professionals holding advanced degrees (master’s or higher, or a bachelor’s plus five years of progressive experience) whose work is in the national interest. The National Interest Waiver allows you to bypass the standard labor certification requirement—and the need for an employer sponsor—if your work qualifies.

The Three-Prong Test (Matter of Dhanasar)

USCIS evaluates NIW petitions under a framework established in Matter of Dhanasar (2016):

  1. Substantial merit and national importance — Your proposed endeavor must have both merit (e.g., scientific, economic, cultural significance) and importance beyond local or regional impact
  2. Well-positioned to advance the endeavor — You must demonstrate education, skills, record of success, and a plan to continue the work
  3. On balance, beneficial to waive the job offer and labor certification — The national benefit of your contributions must outweigh the protections that labor certification is designed to provide

Indian professionals in STEM fields, healthcare, research, and business have pursued NIW petitions successfully. However, “national interest” is a nuanced standard, and documentation matters enormously.

What Is the EB-1A?

The EB-1A category is for individuals who demonstrate extraordinary ability in their field—whether sciences, arts, education, business, or athletics. It requires evidence of sustained national or international acclaim.

Meeting the EB-1A Standard

You must demonstrate either a one-time major achievement (such as a Nobel Prize or an Olympic medal) or satisfy at least three of ten evidentiary criteria, which include:

  • Receipt of lesser nationally or internationally recognized prizes or awards
  • Membership in associations requiring outstanding achievement
  • Published material about you in major media
  • Judging the work of others in your field
  • Original contributions of major significance
  • Authorship of scholarly articles
  • High salary relative to peers
  • Critical role at distinguished organizations

The EB-1A standard is high, but it is a realistic option for senior researchers, physicians with significant publication records, technology leaders, and professionals with documented industry impact.

Priority Dates: Why This Matters for Indian Nationals

Here is where the comparison becomes especially important for Indian professionals: priority dates.

Due to high demand from India, Indian nationals face significant backlogs in the EB-2 category. As of early 2026, the EB-2 priority date for India is many years behind the filing date. In contrast, EB-1A (EB-1) historically has a shorter backlog for Indian nationals, sometimes with a priority date much closer to current.

This means a well-documented EB-1A petition may result in a green card sooner than an EB-2 NIW, even if the EB-2 NIW might otherwise seem like an easier standard to meet.
