For Florida real estate investors, structuring assets correctly is the cornerstone of both growth and protection. As we look toward 2026, the landscape of liability protection and entity structuring continues to evolve. Two primary options dominate the conversation: the traditional individual Limited Liability Company (LLC) and the more complex Florida Series LLC.

Individual LLCs: The Proven Path

The traditional approach involves creating a separate LLC for each property. This provides high legal certainty as Florida courts have long respected this separation.

Series LLCs: Efficiency with Complexity

The Series LLC allows for multiple ‘cells’ under one master filing. While efficient in terms of fees, the legal ‘firewalls’ between series are less tested in Florida courts compared to individual LLCs.
