Tax Tale #1: The Tale of Alexandru Bittner’s Tax Odyssey

Holding a staggering amount across more than 50 bank accounts in countries like Romania, Switzerland, and Liechtenstein, Bittner’s financial journey was nothing short of a global adventure.
However, every adventure has its challenges. Bittner, upon realizing his obligations under the BSA, acknowledged that he had to report his interests in these foreign accounts annually to the U.S. government. But fate had other plans. For five consecutive years, Bittner’s reports went amiss, leading to a confrontation with the mighty U.S. government.
The crux of the matter? The government, viewing each unreported account as a separate violation, slapped Bittner with a penalty for each of the 272 accounts he failed to report. Bittner, on the other hand, believed he had only five violations—one for each year he missed filing the required form.
The U.S. Supreme Court, the highest judicial authority, was tasked with unraveling this financial conundrum. In a landmark decision, the Court sided with Bittner, ruling that the BSA treats the failure to file a legally compliant report as one violation, regardless of the number of accounts. This meant that penalties for nonwillful violations accrue on a per-report basis, not a per-account basis.
