U.S. Department of State Launches Exclusive H-1B Visa Renewal Pilot Program in 2024

Just in time to share the holiday joy, the U.S. Department of State has announced its intention to launch a pilot program for visa renewals within the United States in January 2024. This program will have a limit of 20,000 H-1B visa applications, and applicants will need to submit the Form DS-160 visa application online and initiate the renewal process through a dedicated State Department website for domestic renewals.
Eligibility Criteria for the Visa Renewal Program
This pilot program is specifically tailored for certain H-1B visa holders. Eligibility requirements include:
- Applicants must be in the process of renewing an H-1B visa.
- The current H-1B visa should have been issued by either Mission Canada (from January 1, 2020, to April 1, 2023) or Mission India (from February 1, 2021, to September 30, 2021).
- Applicants should not be subject to a reciprocity fee.
- Qualification for an in-person interview waiver is necessary.
- Applicants must have provided ten fingerprints in a previous visa application.
- The current visa should not have a “clearance received” annotation.
- There should be no visa ineligibilities requiring waivers.
- Possession of a valid and approved H-1B petition is required.
- Recent U.S. entry should have been on an H-1B visa.
- Maintenance of current H-1B status in the U.S. is a must.
- The authorized admission period in H-1B status must still be valid.
- Intentions to reenter the U.S. in H-1B status after temporary travel abroad are necessary.
Application Process and Timeline
To begin the application process, candidates will need to fill out a questionnaire to determine if they are eligible for the pilot program. If they meet the eligibility criteria, they will be guided to complete the Form DS-160, which is the electronic nonimmigrant visa application, and will be required to make a nonrefundable payment of $205 as the application fee.
Application slots will be made available on a weekly basis, starting on the following dates:
- January 29, 2024
- February 5, 2024
- February 12, 2024
- February 19, 2024
- February 26, 2024
Each week, there will be a cap of approximately 4,000 applications: 2,000 from applicants with visas issued by a U.S. consulate in India and 2,000 from applicants with visas issued by a U.S. consulate in Canada. Once the weekly application limit is reached, the State Department will temporarily close the application website until the next scheduled application slot becomes available.
Document Submission and Fee Payment
After the mandatory fee has been paid, applicants will receive instructions regarding the submission of their passport and the necessary application documents to the State Department. The following documents must be sent via U.S. mail or a commercial courier service:
- A fully completed and electronically filed Form DS-160.
- One passport-size photograph that complies with the State Department’s specifications.
- A passport with a minimum validity of six months beyond the visa application date, including an unmarked, blank page.
- A copy of the applicant’s valid and unexpired USCIS H-1B petition approval on Form I-797.
- A copy of the applicant’s valid and unexpired Form I-94 arrival record.
Upon receiving the Form DS-160, application fee, passport, and required documents, the State Department will conduct a thorough screening to determine the applicant’s eligibility for the pilot program. If an application does not meet the screening criteria, it will be returned, but the application fee will not be refunded.
The State Department estimates that the adjudication process for applications will take approximately 6-8 weeks from the date the agency receives the passport and supporting documents, although it may take longer in some cases. Please note that the State Department will not expedite any applications. The agency anticipates that all applications accepted in the pilot program will be processed and finalized by May 1, 2024.
