USCIS Expands Automatic Extension Period for Certain EADs

The U.S. Citizenship and Immigration Services (USCIS) has announced a temporary final rule (TFR) significantly extending the automatic extension period for certain Employment Authorization Documents (EADs). This extension increases the period from up to 180 days to up to 540 days for eligible noncitizens. This measure aims to prevent employment disruptions for work-authorized individuals awaiting EAD renewal adjudications and ensure U.S. employers maintain operational continuity.
The extension is a part of the Biden-Harris Administration’s efforts to streamline work permit access and integrate work-authorized noncitizens into the workforce, enhancing the U.S. economy. USCIS Director Ur M. Jaddou emphasized the agency’s success in reducing EAD processing times and addressing the surge in applications. She stated, “This temporary extension will help avoid employment authorization lapses while DHS seeks long-term solutions.”
This rule applies to eligible applicants who filed an EAD renewal on or after October 27, 2023, and will benefit nearly 800,000 individuals, preventing potential employment authorization and documentation lapses. It also aims to mitigate the impact on an estimated 60,000 to 80,000 U.S. employers.
USCIS’s modernization efforts include halving EAD processing times for green card applicants, extending EAD validity for certain categories to 5 years, and processing a record number of applications. The agency also invites public feedback on this TFR to inform future regulatory actions, demonstrating its commitment to supporting the U.S. workforce and economy through efficient immigration policies.
