Biden-Harris Administration Expands Health Coverage for DACA Recipients 

The Biden-Harris Administration, through the U.S. Department of Health and Human Services (HHS) and the Centers for Medicare & Medicaid Services (CMS), has finalized a rule that will significantly increase access to health coverage for Deferred Action for Childhood Arrivals (DACA) recipients starting November 1, 2024. This new regulation allows DACA recipients to enroll in Qualified Health Plans (QHPs) through the Affordable Care Act (ACA) Health Insurance Marketplace and receive coverage through Basic Health Programs (BHPs).

For the first time, approximately 100,000 previously uninsured DACA recipients will have the opportunity to obtain health insurance. HHS Secretary Xavier Becerra highlighted the change as a critical step towards integrating Dreamers fully into the healthcare system, acknowledging their significant contributions across various sectors of American society. “More than one-third of DACA recipients currently do not have health insurance. Making them eligible to enroll in coverage will improve their health and wellbeing, and help the overall economy,” Becerra stated.

CMS Administrator Chiquita Brooks-LaSure supported this view, emphasizing that health care should be a right for all, including DACA recipients who have established their lives in the U.S. This policy change is expected to reduce the number of uninsured, providing DACA recipients with better access to preventive and routine health care which can decrease the likelihood of emergency health issues and reduce overall health expenses.

Additionally, the rule simplifies and clarifies the definition of “lawfully present” to streamline the process for health coverage eligibility. This adjustment aims to enhance administrative efficiency and transparency, ensuring that eligibility determinations are consistent and accurate. The CMS is committed to providing thorough education and support regarding the implementation of this rule, helping to assist immigrant communities and other stakeholders with the enrollment process.
