Your Post-Graduation Work Authorization Window
For Indian F-1 students, graduation triggers a critical immigration transition. Post-completion OPT provides 12 months of work authorization; the STEM extension adds 24 more, giving a total of 36 months.
OPT Basics
OPT allows F-1 students to work in jobs directly related to their field of study. Employment must relate to your major—unrelated work can jeopardize your status. Maximum unemployment: 90 days during post-completion OPT.
STEM OPT Extension
Requirements: degree on the STEM Designated list, employer enrolled in E-Verify, completed Form I-983 training plan, application filed before initial OPT expires. Combined unemployment limit for STEM OPT: 150 days.
The Cap-Gap Rule
If your OPT expires before October 1 and your employer filed a timely H-1B cap petition while your OPT was still valid, the cap-gap rule extends your status through October 1. Always verify the USCIS receipt notice date against your OPT expiration date—never assume coverage.
If Not Selected in the H-1B Lottery
Options: return to school, pursue O-1 or L-1 (if you worked abroad), or build EB-2 NIW or EB-1A documentation during a period abroad. With lottery odds around 30-40%, planning ahead is essential.
Plan Early
Start building green card documentation during your OPT period. Consult an attorney before your final OPT year, not after urgency sets in.
